REGULATIONS OF THE UNDERWEAR-24.EU ONLINE STORE

I. Definitions

The terms used in the Regulations mean:

1. Customer - a natural person, legal person or an organizational unit that is not a legal person, the special provisions of which grant legal capacity, which places orders within the Store;

2. Seller - PHU MEPA ANNA MOŚCICKA 21-040 Świdnik, ul. Okulickiego 8J

3. Civil Code - the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);

4. Regulations - these Regulations for the provision of electronic services as part of the underwear-24.eu online store;

5. Online Store (Store) - the website available at https://underwear-24.eu , through which the Customer may in particular place Orders;

6. Goods - products presented in the Online Store;

7. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between the SELLER and the Customer, concluded using the Store's website;

8. Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);

9. Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

10. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on data protection);

11. Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Good.

II. General provisions

2.1. These Regulations set out the rules for using the online store available at underwear-24.eu

2.2. These Regulations are the regulations referred to in art. 8 of the Act on the provision of electronic services.

2.3. The underwear-24.eul online store, operating at https://underwear-24.eu , is run by P.H.U. MEPA ANNA MOŚCICKA 21-040 Świdnik, ul. Okulickiego 8J entered into the CEIDG, under number __________. NIP (tax identification number): PL7122474211, REGON (statistical number): 431794762

2.4. These Regulations specify in particular:

a) the rules for registering and using an account as part of an online store;

b) terms and conditions for electronic booking of products available as part of the online store;

c) terms and conditions for electronic submission of Orders as part of an online store;

d) the rules for concluding Sales Agreements using services provided as part of the Online Store.

2.5. Using the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:

a) having a computer or other multimedia device with access to the Internet;

b) a web browser that supports HTML, CSS, JavaScript standards

c) JavaScript enabled

d) Cookies enabled.

2.6. In accordance with applicable law, PHU MEPA company the option of limiting the provision of services via the Online Store to persons who are at least 18 years old. In this case, potential customers will be notified of the above.

2.7. Customers can access these Regulations at any time via the link on the main page of the e-bielizna24.pl website and download it and print it.

2.8. Information about the Goods provided on the Store's websites, in particular their descriptions, technical and functional parameters as well as prices, constitute an invitation to conclude a contract within the meaning of art. 71 of the Civil Code.

III. Rules for using the Online Store

3.1. The Seller may deprive the Customer of the right to use the Online Store, as well as limit his access to part or all of the resources of the Online Store, with immediate effect, in the event of the Customer's violation of the Regulations, in particular when the Customer:

a) provided during registration in the online store data that is false, inaccurate or outdated, misleading or violating the rights of third parties,

b) committed through the online store it violates the personal rights of third parties, in particular the personal rights of other customers of the online store,

c) it commits other behaviors that will be considered by the Seller to be inconsistent with applicable law or general principles of using the Internet or that harm the good name of the Seller.

3.2. A person who has been deprived of the right to use the online store may not register again without the prior consent of the Seller.

3.3. In order to ensure the security of the transmission of messages and data in connection with the services provided as part of the Website, the Online Store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data sent on the Internet.

3.4. The customer is obliged in particular to:

a) not to provide or transfer content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,

b) use the Online Store in a way that does not interfere with its operation, in particular by using specific software or devices,

c) not taking actions such as sending or placing unsolicited commercial information (spam) as part of the Online Store,

d) use the Online Store in a way that is not inconvenient for other customers and for the Seller,

e) use any content posted as part of the Online Store only for personal use,

f) use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

IV. The procedure of concluding the Sales Agreement

4.1. In order to conclude a Sales Agreement via the Online Store, go to the underwear-24.eu website, select the Good, its color and size, taking further technical actions based on the messages displayed to the Customer and information available on the website.

4.2. The choice of Goods ordered by the Customer is made by adding them to the basket.

> 4.3. When placing the Order - until the "Order with payment obligation" button is pressed - the Customer has the option of modifying the entered data and in the selection of the Good. For this purpose, follow the displayed messages and information available on the website.

4.4. After the Customer using the Online Store has provided all necessary data, a summary of the placed Order will be displayed. The summary of the Order placed will contain information on:

a) the subject of the order,

b) unit and total price of ordered products or services, including delivery costs and additional costs (if any),

c) chosen payment method,

d) the chosen delivery method,

e) delivery time,

4.5. In order to send an order, it is necessary to confirm the fact of reading the Regulations and agree to the processing of personal data provided in the registration form marked as mandatory and pressing the "Order with obligation to pay" button. Incorrectly filled order forms will not be considered and processed.

4.6. Sending the Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with the Seller, in accordance with the Regulations.

4.7. After placing the Order, the Customer receives an email containing the final confirmation of all relevant elements of the Order.

4.8. The contract is considered concluded when the Customer receives the e-mail message referred to above.

4.9. The sales contract is concluded in Polish, in accordance with the Regulations.

4.11. Personal data is used only to process orders and - subject to separate consent by the Customer - to process his personal data for marketing purposes to inform about new products, services and promotions offered by the underwear-24.eu store and will not be disclosed to other entities except for authorized entities. The customer has the right to request the administrator to access personal data, the right to rectify it, delete or limit processing, the right to object to the processing, as well as the right to transfer data; I have the right to lodge a complaint to the UODO when it is justified that my personal data is processed by the administrator in breach of the General Data Protection Regulation personal data dated April 27, 2016. Entrusted personal data are stored in accordance with the principles and safeguards in accordance with the requirements set out in applicable law in the Republic of Poland, including:

a) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Regulation on the Protection of data);

b) the Act of August 29, 1997 on the protection of personal data (Journal of Laws 2016 item 922, as amended);

c) the Act of 18.07.2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

4.12. After the shipment of the purchased goods, the Store, as part of the contract with the Buyer, is authorized to send the Buyer an e-mail invitation to complete the survey to examine his opinion on the transaction. The buyer is entitled, but not obliged to complete it.

4.13. Orders can be placed 24 hours a day throughout the year. Orders placed on weekdays after hours. 12:00, and on Saturdays, Sundays and holidays will be considered from the morning of the next working day. For larger orders underwear-24.eu store reserves the right to implement them in separate batches, but the cost of shipping will be calculated only once.

4.14. The store stipulates that there is a likelihood of situations when the goods appearing as available in the online store are in fact out of stock due to delays in synchronizing the warehouse system with the website. In such a situation, the Store reserves the right to refuse the transaction and undertakes to inform the Customer about the situation and to bring the missing goods or if it is not possible to exchange it for another product or to return the cash.

4.15. The underwear-24.eu store reserves the right to withdraw individual products from sale.

  

V. Delivery

5.1. The delivery of Goods is limited to the area of the European Union and takes place at the address provided by the Customer when placing the Order.

5.2. Delivery of ordered Goods takes place:

- by courier

- parcel post

- InPost Parcel lockers 24/7

It is also possible to collect personal goods. Delivery costs are indicated directly on underwear-24.eu. In addition, delivery costs will be indicated when placing the Order.

5.3. The delivery deadline consists of:

- the time of shipment of the product, which is always given on the card of a given product,

- the delivery time of the shipping company, which is from 1 to 5 working days in Poland and up to 10 days in the EU from the day the Store sends the Order.

5.4. The above provision shall not apply if a different delivery date has been provided on the store's website. In the absence of goods in the warehouse, the customer is immediately informed of this fact and the associated extension of the time of order processing.

5.5. The receipt or VAT invoice is supplied with the package.

5.6. Customers can access these Regulations at any time via the link on the main page of the e-bielizna24.pl website and download it and print it.

Consolidation, protection, disclosure and confirmation to the Customer of the essential provisions of the Contract for the Sale of Goods are made by sending the Customer to the e-mail address provided and by attaching a printout of the confirmation or invoice to the parcel containing the Goods.

VI. Prices and payment methods

6.1. The prices of the Goods are given in Polish zlotys or euros and contain all components, including VAT (23%), customs and all other components, the prices of goods do not include shipping costs.

6.2. The customer has the option of paying the price:

a.) by transfer to a bank account number

b.) electronic payment in PayPal, PayU

c.) payment by VISA, MASTERCARD (payment card is charged before shipment)

d.) using cryptocurrencies: Bitcoin, Ethereum, Litecoin and 40 others, in the CoinGate system

e.) cash on delivery (payment after shipment, upon delivery of the goods to the Customer by the carrier selected when placing the Order).

VII. Right of withdrawal

The customer has the right to withdraw from this contract within 14 days without giving any reason.

The deadline to withdraw from the contract expires after 14 days from the day on which the customer came into possession of the item or on which a third party other than the carrier and indicated by the customer came into possession of the item.

To exercise the right of withdrawal, the customer must inform:

Your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or e-mail).

The customer can use the model withdrawal form (download the form), but it is not mandatory.

To meet the deadline to withdraw from the contract, it is sufficient for the Customer to send information on performanceego Customer the right to withdraw from the contract before the deadline to withdraw from the contract.

Effects of withdrawal from the contract

In the event of withdrawal from this contract, the Store returns to the Customer all payments received, including the costs of delivery (except for additional costs resulting from the delivery method chosen by the Customer other than the cheapest usual delivery method offered by the Store), immediately, and in any case not later than 14 days from the day on which the Store was informed of the Customer's decision to exercise the right to withdraw from this contract.

Payment will be returned by the Store using the same payment methods that were used by the Customer in the original transaction, unless the Customer expressly agreed to a different solution.

In any case, the Customer does not incur any fees in connection with this return.

The store may withhold reimbursement until receipt of the item or until proof of sending it back has been provided to us, whichever occurs first.

immediately, and in any case not later than 14 days from the day on which the Customer informed about withdrawal from this contract.

The deadline is met if the customer sends the item back within 14 days.

The customer will then have to bear the direct cost of returning the item.

The customer is only responsible for reducing the value of the item resulting from using it in a different way than was necessary to determine the nature, characteristics and functioning of the item. The goods cannot be damaged or show signs of use. It must also be in the original, undamaged packaging with a set of tags. Failure to comply with the above conditions will result in the loss of the right to withdraw from the contract.

General Warranty Terms for purchased Goods

All goods available in the Store have a manufacturer's, importer's or seller's warranty. The seller undertakes to provide the customer with goods free from defects.

Defective goods should be securely packed in their original packaging with any accessories that the customer received upon delivery.

The product must be delivered in its original packaging. In the absence of packaging, the risk of damage to goods during transport shall be borne by the advertiser.

The store reserves the right to return the advertised product if the product was delivered without complete documentation. If the above conditions are not met, the advertised goods will be sent back at the expense of the recipient.

By withdrawing from the contract, the Customer agrees to the processing of his personal data on the basis of Article 6 paragraph 1 point c of the General Regulation on the Protection of Personal Data of 27 April 2016, in the scope of: name, surname, address, telephone number, bank account number by Seller to refund the purchased goods as a result of withdrawal from the contract.

The customer declares that he knows that personal data will be stored for a period of 5 years and that they have the right to request from the administrator access to personal data, the right to rectify, delete or limit processing, the right to object to the processing, as well as the right to transfer data; I have the right to lodge a complaint to the UODO when it is justified that personal data are processed by the administrator in breach of the general regulation on the protection of personal data of April 27, 2016.

The customer declares that he is aware that providing personal data is required in order to make a refund and payment. The consequence of not giving the above personal data is no refund possible.

VIII. Complaints about Goods

8.1. The seller as a seller is liable to the customer who is a consumer within the meaning of art. 22 [1] of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in art. 556 and art. 556 [1] - 556 [3] of the Civil Code.

8.2. Complaints arising from the violation of the Customer's rights guaranteed by law, or under these Regulations, should be directed to the address sklep@e-bielizna24.pl, the Seller undertakes to consider each complaint within 14 days, and if it was not possible, to inform during this period, when the complaint will be considered.

8.3. The seller is not a producer of goods. The manufacturer is responsible for the warranty of the sold Goods on the terms and for the period indicated in the warranty card. If the warranty document provides for this possibility, the Customer may submit his claims under the warranty directly at the authorized service whose address is in the warranty card.

 

IX. Newsletter

1. Email Newsletter service is provided by: the Seller

2. As part of the E-mail Newsletter service, information is sent via e-mail to the e-mail address provided by the Customer (e-mail address), hereinafter referred to as the "Newsletter". The Newsletter service is provided free of charge for an indefinite period. The newsletter contains information about the offer of products offered by the online store and current promotions.

2.1. By subscribing to the Newsletter Email, the Customer agrees to the processing of his personal data in the scope of: email address for sending the Email Newsletter by the Seller and declares that he knows that his personal data will be stored until he withdraws his consent to data processing for marketing purposes. The consent granted may be withdrawn at any time by sending an e-mail to the following address: sklep@e-bielizna24.pl. The customer declares that he knows that he has the right to request the administrator to access personal data, the right to rectify it, delete or limit processing, the right to object to the processing, as well as the right to transfer data; has the right to lodge a complaint to the UODO, when it is justified that his personal data are processed by the administrator contrary to the general regulation on the protection of personal data of April 27, 2016. The customer declares that he is aware that providing personal data voluntary, however, failure to provide data to the extent required by the administrator results in the inability to use the Email Newsletter service.

3. Using the E-mail Newsletter service depends on the Customer having a computer or other multimedia device with access to the Internet and the Customer having an active e-mail account.

X. Complaints regarding the provision of electronic services

9.1. The Seller undertakes actions to ensure the fully correct operation of the Store, to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any irregularities reported by customers.

9.4. In the complaint, the Customer should provide his name and surname, correspondence address, type and date of irregularities related to the functioning of the Store.

9.5. The seller undertakes to consider each advertisement within 14 days, and if this was not possible, to inform the Customer within this period when the complaint will be considered.

XI. Personal data and privacy policy. Information obligations.

1. Personal data provided by the Customer during the registration or ordering process are processed by the Seller of PHU MEPA ANNA MOŚCICKA 21-040 Świdnik, ul. Okulickiego 8J, which is the administrator of personal data.

2. An indispensable element of the account creation and order placement procedure is the Customer providing his personal data marked as obligatory and expressing his consent to the processing of his personal data provided during registration. Providing personal data marked as mandatory is voluntary, however, it is necessary to register and place an order, their implementation and service. Providing personal data not marked as obligatory is voluntary.

3. In the event that the Customer has expressed a separate consent to the service provided by electronic means, the subject of which is the free delivery of newsletters, the obtained e-mail address (e-mail address) is added to the mailing list and is used for marketing purposes to send the Customer commercial information via elein the form of a Newsletter, in accordance with point IX of these Regulations.

4. The consent to the processing of personal data is given by the Customer ticking the appropriate box on the form.

5. The collected personal data are not disclosed to third parties, except for the transfer of data to entities participating in the implementation of the order in order to provide the customer with the ordered goods, ie DPD POLSKA Sp. z o. o. with its registered office in Warsaw, Poczta Polska SA, RUCH SA or InPost. If payment for the ordered goods is made in advance or in InPost Parcel Locker, the data is also transferred to the entity through which the transaction is settled. The scope of transmitted data is limited to the necessary minimum, in accordance with the principle of minimizing personal data.

The customer has the right to request the administrator to access personal data, the right to rectify it, delete or limit processing, the right to object to the processing, as well as the right to transfer data. 7. The customer has the right to obtain information whether and to what extent his personal data are processed, as well as information about the purpose and scope of processing his personal data. For this purpose, he should contact the Seller in the manner indicated in point 6 above.

8. The Seller, as the administrator of personal data, may entrust another entity, by way of a written contract, with the processing of personal data, subject to the provisions of Art. 28 GDPR;

XII. Final provisions

10.1. Settlement of any disputes arising between the Seller and the Customer who is a consumer within the meaning of art. 22 [1] of the Civil Code, will be surrendered competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure, except that the parties choose the court competent for the seat of the Seller.

10.2. The consumer is also entitled to use extrajudicial means of dealing with complaints and redress, including:

a) The consumer is entitled to apply to a permanent amicable consumer court operating at the Trade Inspection with a request to settle the dispute arising from the concluded sales contract.

b) The consumer is entitled to request the Provincial Inspector of Trade Inspection to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.

c) The consumer may obtain free assistance at the headquarters of the poviat (municipal) consumer ombudsman or social organization whose tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).

10.3. The consumer may use extrajudicial means of dealing with complaints and redress. In order to take advantage of the possibility of amicable settlement of disputes regarding online purchases, the Consumer may submit his complaint, e.g. via the EU ODR online platform, available at address: http://ec.europa.eu/consumers/odr/.

10.4. Settlement of any disputes arising between the Seller and the Customer who is not a consumer within the meaning of art. 22 [1] of the Civil Code of the Civil Code, is subject to the court having jurisdiction over the seat of the Seller.

10.5. In matters not covered in these Regulations, the provisions of

The European Commission gives consumers the opportunity to resolve online disputes pursuant to Art. 14 Para. 1 of the ODR on one of their platforms. The platform (http://ec.europa.eu/consumers/odr) serves as a site where consumers can try to reach out-of-court settlements of disputes arising from online purchases and contracts for services.
